====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 303(2), 308(3), 324(4), 352, 3(5) of the Bharatiya Nyaya Sanhita.
3. It is alleged that on 31.10.2024 at about 9:45 PM, informant was going to the railway station with Vijay Kumar to catch the train by his motorcycle, in the meantime, all the F.I.R. named accused persons including this petitioner stopped them and demanded Rs. 5,000/- as extortion. It is further alleged that all the accused persons assaulted informant and Vijay Kumar by means of lathi, danda and snatched Rs. 5,000/- from the pocket.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation
Patna High Court CR. MISC. No.21482 of 2025(2) dt.30-04-2025 2/2 of assault is general and omnibus and there is no specific allegation of overt act against petitioner. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani in connection with Jhanjharpur R.S. P. S. Case No. 95 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
