The petitioner seeks bail in connection with Baikunthpur P.S. Case No.78 of 2009 registered under Sections 302 and 34 of the Indian Penal Code.

The informant has alleged in the written report that he got information from the villagers that her husband has been killed and his dead body is lying in the field. The informant raised suspicion against four persons.

Learned counsel for the petitioner submits that petitioner is not named in the written report. The name of this petitioner has come only on the basis of confessional statement of Kanhaiya Manjhi who has already been granted bail by a coordinate Bench of this Court vide order dated 26.04.2010

Patna High Court Cr.Misc. No.73082 of 2018(2) dt.11-12-2018 2/2 passed in Cr. Misc. No.12725 of 2010.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No.78 of 2009.
