Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 467, 468, 471/ 120 (B) of the Indian Penal Code.

It is alleged that after assassination of the parents of the informant the prime accused of the said assassination created a forged Jamabandi receipt with respect to the land inherited by the informant and transferred the same to the petitioner only with a view grab the land of the informant. It is submitted that petitioner is innocent and nothing has been forged by him. The petitioner has not impersonated any person nor any other person named in the F.I.R and petitioner is bona fide purchaser and had not cheated any body

Patna High Court CR. MISC. No.22613 of 2023(2) dt.06-07-2023 2/2 nor misappropriated any amount. The dispute is purely of civil nature and as such, no offence as alleged is made out against the petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S. case no 352 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
