The petitioner seeks bail in Bahera P. S. Case No. 266 of 2017 instituted for the offence under Section(s) 406, 420 and 376 of the Indian Penal Code.

In the written report, it is alleged that this petitioner who was the driver of Magic vehicle in the school on the pretext of performing marriage with the informant established physical relationship with her and took an amount of Rs one lacs twenty thousand for construction of the house. Leaned counsel for the petitioner submits that petitioner neither returned the money nor performed marriage with informant. It has further been submitted that now good sense has prevailed and both parties have compromised the

Patna High Court Cr.Misc. No.71215 of 2018(2) dt.10-12-2018 2/2 case. A joint compromise petition has been filed in the court below which is annexed as Annexure-2 to the bail petition. Petitioner is in custody since 1.9.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Benipur, Darbhanga., in connection with Bahera P. S. Case No. 266 of 2017, G.R. No. 302 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
