2. The petitioner apprehend their arrest in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 1206 of 2024, registered for the offences punishable under Sections 318(4), 316(2), 316(5), 3(5) of the BNS, 2023 (420/406/409/34 of the Indian Penal Code).

3. The prosecution case, in short, is that the President, Dilip Kumar (petitioner no. 1) and the Secretary, Deshbandhu Azad (petitioner no. 2) of Maheshua PACS, misappropriated

Patna High Court CR. MISC. No.23271 of 2025(5) dt.25-09-2025 2/3 1791.5 quintals of paddy (worth Rs. 39,55,632/-) by black marketing, instead of supplying the due CMR to Bihar State Food Corporation, Madhepura, despite repeated notices and verifications.

4. The learned counsel for the petitioners has submitted that in compliance of order dated 23.07.2025, they went to the Chairman, PACS and deposited Rs. 2 lakhs. He has further submitted that they shall deposit Rs. 3 lakhs at the time of furnishing the bail bond and the remaining amount will be deposited in equal monthly installments till December 2026.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 1206 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.

6. The bail bond shall be accepted only after the payment of the aforesaid Rs. 3 lakhs and if the petitioners fail to deposit the entire money till December 2026 their bail bond shall be cancelled by the court below. The State Government will be at liberty to recover the interest/loss by taking the recourse of law.

7. Their bail bond shall be cancelled if it is found that they are involved in any other case.
