The petitioner apprehends his arrest in Piri Bazar P.S. Case No. 03 of 2017, registered for the offences punishable under Sections 30(K) & 38 (1)(2) of the Bihar Excise (Amendment) Act, 2016.
The informant alleged that on seeing the police two persons started fleeing away. One person who was having a bag in his hand was apprehended and another person managed to flee away. The apprehended accused disclosed his name as Jai Jai Ram Yadav @ Putni. He disclosed the name of the petitioner who managed to flee away. On search, seven liters of country made liquor made of Mahua was recovered from his possession. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and he is not alleged to
Patna High Court Cr.Misc. No.15572 of 2017 (2) dt.13-04-2017 2/2 carrying any bag in his hand. Jai Jai Ram Yadav @ Putni was carrying the bag from which country made liquor was recovered. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Piri Bazar P.S.
