JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 2101 of 2015, registered under Sections 406, 494 and 498A of the Indian Penal Code.

The accusation is of torturing the informant-opposite party no. 2 by her husband and in-laws due to non-fulfillment of demand of dowry and also to remove her to matrimonial house along with her child snatching her personal belongings. Learned counsel for the petitioner submits that petitioner is the husband of the complainant-opposite party no.2

Patna High Court Cr.Misc. No.18894 of 2017 (6) dt.29-11-2017 and he is ready to keep his wife-opposite party no. 2 with full dignity and honour. In fact, complainant-opposite party no. 2 used to reside at her 'Maika' and notice has been received by her mother in spite of that opposite party no. 2 has not appeared in this Court.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Saharsa, in connection with Complaint Case No. 2101 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
