Mr. Sri Rajendra Prasad Nat ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioners seek bail in connection with Bihta P.S. Case No.1015 of 2018 registered under Sections 307, 353, 34 of the Indian Penal Code and under Section 4/40 of the Bihar Minor Mineral Concession Rule, 1972 and Section 3, 6 and 8 and also under Section 27 of the Arms Act.

In the written report, it is alleged that informant got information about loading of illegal consignment in the boat. The informant reached at the place of occurrence. The accused persons started firing. Police also made firing. Police arrested 11 persons on the spot which include the petitioner.

Patna High Court Cr.Misc. No.74168 of 2018(2) dt.11-12-2018 2/2 Learned counsel for the petitioner submits that there is no recovery of any used or live cartridge from the place of occurrence. From the written report itself, no injury has been caused to anybody. It is submitted that other accused persons have already been granted bail by a coordinate Bench of this Court vide order dated 06.12.2018 passed in Cr. Misc. No.72123 of 2018.

Considering the facts aforesaid, all the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Danapur, Patna in connection with Bihta P.S. Case No.1015 of 2018. Both the bailors will be close relative of the petitioners.
