2. The petitioner seeks bail in connection with Govindganj (Malahi) P.S. Case No. 689 of 2023 registered for the offence punishable under Section-376 of the Indian Penal Code and Sections-4 & 6 of the POCSO Act.

3. Learned counsel for the petitioner has submitted that earlier prayer for bail of the petitioner was rejected by order dated 30-07-2024 passed in Cr. Misc. No. 26696 of 2024 but the petitioner is renewing his prayer for bail since there is no progress at all in the trial. The charges were framed on 11-022025 and thereafter several dates have been given to the

Patna High Court CR. MISC. No.21039 of 2025(4) dt.12-09-2025 2/2 prosecution to produce its witnesses but in six months, not a single witness has been examined.

4. On the otherhand, learned APP has opposed the prayer for bail.

5. The present bail application is disposed of with observation that if the trial is not concluded within a period of nine months, the petitioner shall be at liberty to renew his prayer for bail.
