JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri Mithilesh Kumar Upadhyay, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Complaint Case No.409/2016 registered for the offence under Section 47(A) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner is a labourer and he had taken lift in a Bolero vehicle, while he was returning from his work place. Subsequently, said vehicle was intercepted and from the said Bolero vehicle, 29 Liters of foreign make liquor was recovered. Keeping in view the nature of accusation and clean antecedent of the petitioner, let the petitioner, namely, Pintu Sharma @ Pintoo Sharma be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Complaint Case no.409 of 2016.
