1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.
3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner nos.3, 4 and 5 are women. It is next submitted that on account of
Patna High Court CR. MISC. No.27231 of 2024(2) dt.23-04-2024 2/3 dispute relating to land, the informant falsely implicated the petitioners. It is next submitted that from perusal of the F.I.R., it would manifest that the informant alleges that petitioner no.1 assaulted his wife by spade causing injury on head and wrist, petitioner no.2 pulled the hair of his mother and dashed her on the ground and thereafter, it is alleged that the other accused assaulted her, petitioner no.3 is alleged to have snatched gold nose pin of his wife while petitioner no.4 is alleged to have snatched silver bangles and petitioner no.5 is alleged to have snatched silver chain of the informant's wife.
It is next submitted that even presuming what has been alleged is true without admitting, then wife of the informant received simple injury caused by hard and blunt substance and the blow was not repeated, when it is alleged that petitioner no.1 assaulted by spade which is a sharp edged weapon. It is further submitted that there is a delay of eight days in instituting the instant F.I.R. which cast an aspersion on the case of the prosecution.
4. Learned A.P.P. opposes the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.27231 of 2024(2) dt.23-04-2024 3/3 within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Birpur, Supaul in connection with Nirmali P. S. Case No.206 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
