The petitioners are apprehending their arrest in connection with Sonepur P.S. Case No. 487 of 2016 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and 30(a), 33, 34(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

It has been submitted on behalf of the petitioners that in absence of the petitioners it is alleged that 30 litres of country made liquor have been recovered and except that there is nothing against them and they have clean antecedent.

Heard learned APP also.

Having heard both sides and in view of Section 76(2)

Patna High Court Cr.Misc. No.12382 of 2017 (2) dt.23-03-2017 2/2 of Bihar Prohibition and Excise Act, 2016, I am not inclined to grant anticipatory bail to the petitioners.

However, let the petitioners surrender and pray for regular bail before the court below, who shall consider the same on its own merit and the submission made here and pass an appropriate order.
