2. The petitioner seeks bail in a case registered for offence under Sections 399, 402, 413 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

3. As per prosecution case, the petitioner was apprehended with one country-made pistol loaded with two live cartridges.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner has no concern with the so-called incident and with any other person, who has been named, arrested or remanded in this case. He further submits that co-accused Sarfaraz @ Prince has already been granted bail by this Court, vide order dated 16.11.2021 passed in Cr.Misc. No. 45798 of 2021 (Annexure P/2). Petitioner is in custody since 28.03.2021.

5. However, learned A.P.P. for the State vehemently opposes the prayer for bail and submits that petitioner was apprehended on spot with one country-made pistol loaded with two live cartridges and petitioner has also got 10 (ten) criminal antecedents.
