JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Tajpur P.S. Case No. 297 of 2016 instituted for the offence under Section 7 of the Essential Commodities Act.
It has been submitted on behalf of the petitioner that he is a free sale dealer and the seized rice belongs to him. He has got release order of that rice in his favour by this Hon'ble High Court vide C.W.J.C. No. 20239 of 2016.
As per the allegation in the written report, total 364 bags of rice and 14 bags wheat kept in the godown and 315 bags of rice loaded in a truck which was standing outside the godown, were recovered. The petitioner claims that those seized rice belongs to him and he also got those articles released in his favour
Patna High Court Cr.Misc. No.7927 of 2017 (2) dt.27-02-2017 2/2 by the Hon'ble High Court in C.W.J.C. No. 20239 of 2016. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Tajpur P.S. Case No. 297 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Samastipur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
