JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section47(k) of the Bihar Excise (Amended) Act, 2016. Twenty bottles each containing 375 ml. Indian made foreign liquor are said to have been recovered from conscious possession of the petitioner, while he was travelling by SahebganjDanapur Intercity express but submission on behalf of petitioner is that the aforesaid recovery was made from beneath a seat on which, the petitioner was found sitting and the aforesaid circumstance gave opportunity to the Excise Official to implicate the petitioner in the present case. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody

Patna High Court Cr.Misc. No.38834 of 2016 (2) dt.20-09-2016 2/2 since 31-07-2016.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with P.S. Case No. 244 of 2016 to the satisfaction of Chief Judicial Magistrate, Bhagalpur.
