2. The petitioner apprehends his arrest in connection with Bachhwara P.S. Case No. 117 of 2022 registered under Sections 188, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. It is alleged that 445 litres of illicit liquor were recovered from the maize field of co-accused Jhunna Chaudhary.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that the recovery of illicit liquor has been made from the maize field of co-accused Jhunna Chaudhary. Nothing has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.24755 of 2024(2) dt.19-04-2024 2/2 petitioner. The petitioner is accused in one other case having similar nature in which he is on bail.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge Excise-I, Begusarai in connection with Bachhwara P.S. Case No. 117 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
