The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The prosecution case is that the informant was robbed on the road when FIR was lodged against unknown. The informant claimed to have identified the miscreants by their face and the informant in his subsequent statement named the petitioner.
It is submitted by learned counsel for the petitioner that on the pressure of the police the informant named the petitioner subsequently and there is no recovery from him. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court
Patna High Court Cr.Misc. No.43012 of 2015 (2) dt.14-10-2015 2/2 below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nardiganj P.S. Case No.30 of 2015, pending before the learned CJM, Nawada.
With the above observation, this application is, accordingly, disposed off.
