SONI SHRIVASTAVA ORAL ORDER 23-07-2025 At the outset, learned counsel for the petitioners prays for withdrawal of the anticipatory bail application on behalf of petitioner no. 2, Hemraj Choudhary.
2. Permission is granted.
3. Accordingly, this application on behalf of petitioner no. 2 is dismissed as withdrawn. The application now survives only against petitioner no. 1
4. Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and the learned counsel for the informant.
5. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 34 of the Indian Penal Code.

6. Allegation in the first information report is that the informant and others were assaulted by the accused persons when they had come for social reforms by carrying a movement in favour of liquor prohibition.
7. Learned counsel for the petitioner submits that so far as the petitioner no. 1 is concerned, there is an allegation that upon instigation of one Bablu Choudhary the petitioner Rakesh Choudhary gave a knife blow on the back of Ramu Choudhary, who is the brother of the informant. It has been submitted that the petitioner and the informant's side are agnates and the injured Ramu Choudhary has received one injury which is simple in nature as would be evident from the injury report annexed as Annexure-P/2.
8. Learned APP for the State and learned counsel for the informant have opposed the application for anticipatory bail and stand by the allegation made in the first information report.
9. Considering all the above mentioned facts and circumstances, let the above named petitioner no. 1 in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
