JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners seek bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 25.01.2022, are persons with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 87.36 litres of liquor from

Patna High Court CR. MISC. No.23025 of 2022(2) dt.06-05-2022 2/2 a plastic bag kept on a motorcycle.

Learned counsel for the petitioners submits that the petitioners were completely unaware that who had kept the plastic bag on the motorcycle which was parked when the petitioners had gone to attend the call of nature. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 25.01.2022, are persons with clean antecedent and chargesheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Brahmpur (Nainijor) P.S.
