JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 03.02.2016 passed in Cr. Misc. No. 35142 of 2015 which was disposed of with Cr. Misc. No. 30060 of 2015, on the ground that the petitioner is suffering in custody since 12.01.2015, there is no legal and tangible material against the petitioner, he has been sent to Gaya Central Jail, resulting, there is no progress in the case and as such the petitioner deserves sympathetic consideration.

Learned APP opposes the prayer of bail by submitting that in this case Md. Sahabuddin was granted bail by this Court which has been cancelled by the Apex Court and against the petitioner there is sufficient material as he with another co-accused was seen at the place of occurrence in suspicious condition further

Patna High Court Cr.Misc. No.48476 of 2016 (3) dt.14-12-2016 the petitioner was talking that he has finished the job by killing Rajeev Roushan but he has not been paid agreed amount. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected.
