2. The petitioner seeks regular bail in connection with Nardiganj P.S. Case No. 454 of 2024 registered for the offence under Sections 126(2), 115(2), 303(2), 74, 117(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and subsequently Sections 109, 103(1) of the B.N.S. was also added.

3. The assailant of the deceased is one Vijay Choudhary, who has assaulted the deceased with iron road in his hand. The deceased has sustained only one injury i.e., in his hand caused by hard blunt substance and has died.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateII, Nawada/concerned Court below in connection with Nardiganj P.S. Case No. 454 of 2024 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner.

8. The application for bail stands allowed.
