JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-08-2015 Defendants of Title Suit No. 52 of 1995 have filed the present application against the order dated 14.1.2011 passed by the Trial Court rejecting the application dated 18.8.2010 filed by them for rejection of the document dated 3.4.1995 as forged /false/concocted document. The aforesaid document was admitted in evidence by the Court. One of the reasons for rejecting the application of the defendants assigned in the order is that the Court has yet to form an opinion with regard to the genuineness or otherwise of the said document. The stage at which the application was filed found relevant for rejecting the application. The case was set for final argument when the said application was filed.
Patna High Court CWJC No.6930 of 2011 (2) dt.28-08-2015 2/2 On going through the pleadings in the application and the reasons assigned in the order, in my view, the Trial Court has not committed any grievous illegality meriting invocation of writ jurisdiction.
