Petitioner seeks bail in a case registered under sections 302, 307, 120-B of the Indian Penal Code and 27 of the Arms Act. Petitioner is named in the first information report and the informant claims that the petitioner made indiscriminate firings causing death of the deceased. In course of investigation, some witnesses disclosed that the assailant was looking like the petitioner. The post mortem report of the deceased goes to show that deceased sustained several fire arm injuries.

Moreover, petitioner does have criminal antecedent of five cases and therefore, taking note of the aforesaid facts as well as antecedent of the petitioner, I do not feel it proper to release the petitioner on bail and hence, his prayer for bail in connection with

Patna High Court Cr.Misc. No.40398 of 2016 (3) dt.19-11-2016 Kanti P.S. Case no. 536/2015 corresponding to Sessions Trial no. 208/2016 pending in the court of Addl. Sessions Judge XII, Muzaffarpur stands rejected.
