The petitioner apprehends his arrest in Kuchaikot P.S. Case No. 108 of 2016 registered for the offences punishable under Sections 341, 147, 323, 307, 379 and 504 of the Indian Penal Code.
The informant alleged that the petitioner assaulted Harkesh Prasad with brick causing injury on his head. Learned counsel for the petitioner submits that the injury of Harkesh Prasad is simple in nature and the occurrence is due to land dispute, but from the injury report it appears that it was the petitioner who assaulted Harkesh Prasad and the injury no. 1 found on the head of Harkesh Prasad is grievous in nature. Considering the facts aforesaid, I am not inclined to
