JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 This application, for grant of anticipatory bail, arises out of Jamui P.S. Case No. 246/17, disclosing offences under Sections 341, 323, 364 of the Indian Penal Code. Allegation as per F.I.R is that petitioner, who is working in Jaipur approached the informant and his husband to come along with him to Jaipur for earning, thereafter, on the assurance of petitioner, husband of the informant went with him and started earning there and also started to send Rs. 10,000/- each month to the informant. After some time, the husband of informant informed the informant that he is coming home with the petitioner and others but he did not come to home and when she enquired from the petitioner, he did not give satisfactory answer, then, informant went to the Jamui Police Station, where Rs. 10,000/-, a bag and some clothes were handed over to her and she was assured that her husband would return soon but he

Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion and except that there is nothing against the petitioner and in spite of investigation, nothing has come against the petitioner.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 246/17, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
