Mr.Amitesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-09-2020 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State, through Video Conferencing.

The petitioner seeks regular bail in connection with Goraul Police Station Case No. 49 of 2020, registered for the offence punishable under Sections 25(1-b)a/26 of the Arms Act. The allegation against the petitioner, as per the First Information Report, is that the police recovered a loaded country-made pistol from the waist of the petitioner and also one live cartridge from his pocket along with one mobile phone. Learned Counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely been implicated in this case. He further submits that the petitioner is in custody since 04.02.2020.

No.23968 of 2020(2) dt.18-09-2020 2/2 After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than six months, I am inclined to grant regular bail to the petitioner.

This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Vaishali, at Hajipur, in connection with Goraul Police Station Case No. 49 of 2020.

It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
