Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 13 of 2020, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

At the very outset, learned counsel for the petitioner has submitted that when the real fact came to the knowledge of the informant, he has filed a compromise petition, mentioning therein that he is filing a compromise petition after knowing the

Patna High Court CR. MISC. No.32043 of 2021(2) dt.01-02-2022 2/2 real fact about death of his daughter. The compromise petition has been annexed with the record as Annexure-2. Learned counsel for the petitioner has also submitted that other co-accused persons have been granted anticipatory bail by the coordinate Bench of this Court in Cr. Misc No. 30983 of 2020 vide order dated 22.01.2021.

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S. Case No. 13 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
