2. Lastly, the prayer for bail of the petitioner was rejected by this Court vide order dated 21.06.2023 passed in Cr. Misc. No. 9080 of 2023.

3. As per prosecution case, 35 kg Ganja was recovered from Ambassador Car and 15 kg Ganja was recovered from Swift Dzire Car. It is alleged that this petitioner along with co-accused person was apprehended on spot.

4. Learned counsel for the petitioner submits that earlier prayer for bail of the petitioner was rejected with direction to the Trial Court to conclude the trial as early as possible, preferably, within one year from the date of receipt/production of a copy of the order but till date even

Patna High Court CR. MISC. No.22797 of 2025(2) dt.16-05-2025 2/2 charge has not been framed. It is further submitted that similarly situated co-accused, namely, Pankaj Kumar has already been granted regular bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 11.04.2025 passed in Cr. Misc. No. 21783 of 2025. Petitioner is in custody since 28.06.2020. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XII, Bhagalpur in connection with N.D.P.S. Case No. 19 of 2020, arising out of Industrial P. S. Case No. 58 of 2020.
