JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 It has been submitted that petitioner no.3 has been arrested. Therefore, the prayer for anticipatory bail of petitioner no.3 is dismissed as became infructuous.

Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in Buniyadganj P.S. Case No. 147 of 2016 instituted for the offence under sections 493, 376, 120B, 341, 323, 504, 506/34 of the Indian Penal Code.

It is alleged in the written report that Vikash Kumar brought the informant to his house on the promise to marry her. He kept her in his house and later on, when she told to marry, he

It is alleged that the petitioners made demand of Rs. one lakh.

It is mentioned in para 5 of the bail petition that petitioner no.1 is the father of Vikash Kumar and petitioner no.2 is the grand-mother of Vikash Kumar.

From the written report itself, it appears that there is no specific allegation of overt act against the petitioners. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, (except petitioner no.3) within six weeks from today, in connection with Buniyadganj P.S. Case No. 147/16, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Gaya, subject to the conditions as laid down under Section 438(2) Cr.P.C.
