The petitioner seeks regular bail in Chakia P.S. Case No. 117/2018, registered for the offences punishable under Sections 379, 414, 413 and 120B of the Indian Penal Code. It is alleged in the written report that on secret information the police raided house of co-accused and caught two persons namely, Naushad Alam and Sahzad. Two motorcycles were recovered from house of Sahzad. The apprehended accused disclosed that this petitioner is also used to commit theft of motorcycle with them. They further disclosed that they sold one motorcycle to Rahul Paswan. The police thereafter recovered another motorcycle from the house of Rahul Kumar. 03 Tirpals were recovered from the house of this
Patna High Court Cr.Misc. No.74385 of 2018(2) dt.12-12-2018 2/2 petitioner. There is no recovery of any stolen article from possession of this petitioner.
Learned counsel for the petitioner has submitted that petitioner is in custody since 20.09.2018.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 13th, Motihari, East Champaran in connection with Chakia P.S.
