The petitioner apprehends his arrest in Manjhaulia P.S. case No. 224 of 2016 under Section 363, 366A of the Indian Penal Code.
The informant named the petitioner along with seven other accused persons and alleged that when his daughter went to ease out, the petitioner and others kidnapped his minor daughter. The learned counsel for the petitioner submits that from perusal of the statement of the victim girl under Section 164 of the Cr. P. C., it would appear that the victim left her house and went to the house of her maternal aunt only because her mother scolded her. The victim did not support the factum of kidnapping.

Having considered the fact that victim herself stated in her statement under Section 164 of the Cr. P. C. that she went to house of her maternal aunt on being scolded by her mother, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah in Manjhaulia P.S. Case No. 224 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
