While taking cognizance of the matter it was brought to the notice of this Court that the issue involved in the matter is pending before a Division Bench in LPA No. 313 of 1998 (The State of Bihar vs. Bihar State Basic Health Workers Sangh & Ors.).

It is now brought to my notice that the aforesaid LPA bearing No. 313 of 1998 filed by the State Government has been decided and the judgment granting benefit to the similarly situated persons by the Hon'ble Single Judge has been quashed and the said judgment in the case of State of Bihar vs. Bihar State Health Workers

Patna High Court CWJC No.2702 of 2004 dt.21-09-2017 2/2 Sangh in LPA No. 313 of 1998 is reported in 2009 (2) PLJR 235. In view of the above, no further indulgence is called for.
