16-12-2016 Heard Sri Vipin Kumar Singh, learned counsel for the petitioner and Sri Anant Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Koilwar P.S. Case No. 57 of 2015 registered for offence under Sections 20(B) and 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner was driver of a Bolero vehicle and from the said vehicle, recovery of about 110 Kg. of Ganja was shown. While the petitioner was driving the vehicle, the owner of the vehicle was also there. It has been argued that petitioner was not having any knowledge about the carrying of the Ganja in the vehicle in question.

However, considering the fact that from the vehicle,

Patna High Court Cr.Misc. No.44992 of 2016 (3) dt.16-12-2016 2/2 which was being driven by the petitioner, about 110 Kg. of Ganja was recovered, there is no question for grant of bail. The petition stands dismissed.

Keeping in view the fact that petitioner is in custody since 05-03-2015, while dismissing the present petition, it is desirable to observe that learned court below may take all steps so that the case may come to its logical end without unnecessary delay.
