The petitioner in the present case is seeking pre-arrest bail in connection with Rajoun (Nawada Bazar) P.S. Case No. 30 of 2020 registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has been brought within the purview of this case on the basis of the confessional statement of one Umang Kumar Shah recorded by police in connection with another case. Learned counsel submits that save and except the confessional statement of the co-accused in which the name of this petitioner has transpired no other material has been collected against him.

No.20596 of 2020(6) dt.05-01-2021 2/2 Learned APP for the State has though opposed the prayer for pre-arrest bail of the petitioner but after going through the case diary and the report received from the District Transport Office, Banka, learned APP is unable to demonstrate that the vehicle in question belongs to this petitioner. In the aforesaid facts and circumstances of the case, there being no prima-facie material placed before this Court to connect this petitioner with the present case at this stage, let the provisional bail of this petitioner be confirmed and the petitioner be allowed to remain on bail on the same bail bond.
