The petitioner Manoj Kumar Mishra apprehends his arrest in a case registered under Sections 341, 504, 384, 170/34 of the Indian Penal Code in connection with Madhubani Sadar Town P.S. Case No. 129 of 2012.
The allegation is that the petitioner and others came and abused the informant. One Gagan Kumar Mishra is alleged to have taken out money from the pocket of the informant and also demanded extortion.
Learned counsel for the petitioner submits that Gagan Kumar Mishra against whom there is allegation of taking money has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 34203 of 2013 on 08.10.2013. There is a counter
Patna High Court Cr.Misc. No.51896 of 2014 (2) dt.05-01-2015 version and litigation between the parties.
Learned APP did not dispute the facts.
It appears that the petitioner and Gagan Kumar Mishra are alleged to have abused the informant and took out Rs. 10,000/- from his pocket, they are alleged to have demanded extortion and the case is lodged after much delay. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Sadar Town P.S. Case No. 129 of 2012, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
