The petitioners filed this petition for modification of the order dated 21.08.2015 passed in Cr. Misc. No. 23260/2015 by which the petitioners were granted anticipatory bail. It is submitted that at the time of filing of the aforesaid Cr. Misc. case, only one case, being Mahua P.S. Case No. 428/2014, was pending at the time of grant of anticipatory bail. One more case, being Hajipur Sadar P.S. Case No. 258/15, was registered on 30.05.2015.
It appears that the petitioners were granted bail in the Hajipur (Sadar) P.S. Case No. 258/2015 much prior to the passing of the order granting them anticipatory bail in Cr. Misc. No.
Patna High Court Cr.Misc. No.43811 of 2015 (2) dt.16-12-2015 2/2 23260/2015 but the petitioners did not inform the Court about pendency of another criminal case at the time of hearing and passing the order on 21.08.2015. Therefore, it appears that the petitioners concealed the facts of criminal cases pending against them. Accordingly, I do not find any cogent reason to modify the aforesaid order dated 21.08.2015 passed in Cr. Misc. No. 23260/2015.
This modification petition is accordingly dismissed. (Prabhat Kumar Jha, J) Dilip/- U T
