In this case, the petitioner is seeking regular bail in connection with Nawada P.S. Case No. 192 of 2020 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The police has recovered 75.70 litres of foreign liquor and 2.700 litres of country made liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 26.02.2020.

Looking to the facts and circumstance of the case, the

No.20889 of 2020(2) dt.26-06-2020 2/2 petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Nawada in connection with Nawada P.S. Case No. 192 of 2020, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the same offence, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail granted to the petitioner.
