2. The petitioner seeks regular bail in connection with Kabaiya P.S. Case No. 201 of 2024, registered under Sections 190, 191, 103, 118, 238, 61(2), 62 and 123 of the B.N.S., 2023.

3. As per prosecution case, the petitioner is the brother-in-law of the deceased. He along with others are said to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. During investigation nothing has come to support the prosecution case. Moreover, the deceased was taken to Rajeshwar hospital, Patna

Patna High Court CR. MISC. No.26142 of 2026(2) dt.21-04-2026 2/3 for treatment. Similarly situated co-accused person, namely, Bharat Kumar @ Bharat Yadav has been granted regular bail by a coordinate Bench of this Hon'ble Court vide order dated 15.04.2026 passed in Cr. Misc. No. 14537 of 2026. The petitioner has no criminal antecedent and he is in custody since 12.12.2025.

5. Learned A.P.P. for the State has opposed the prayer for bail.

6. Considering the facts and circumstances of the case, also period of custody and similarly situated co-accused person has been granted bail by a coordinate Bench, this bail application is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Court concerned where the case is pending/successor court in connection with Kabaiya P.S. Case No. 201 of 2024.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
