JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks bail in connection with Kanti P.S.Case No. 500 of 2018 registered under Sections 399,402,413 and 414 of the Indian penal Code and 25(1-b)a/26/35 of the Arms Act.

Allegation, as per the FIR, is that police raided the place of occurrence and arrested nine accused persons and arms and cartridges from them. It is alleged that petitioner succeeded in fleeing away from there and it appears that petitioner is accused in two other cases.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner though he is accused in two other cases, but in those cases, he is on bail and in the present case, petitioner is in custody since

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, West Muzaffarpur in connection with Kanti P.S. Case No. 500 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
