The petitioners are languishing in jail since 19.08.2016 in a case registered for offences punishable under Sections 147,148, 149, 341, 323,307, 504, 506 of Indian Penal Code and under Section 27 of the Arms Act and subsequently Section 302 of the Indian Penal Code has been added.

The prosecution case is that the petitioner along with other co-accused tried to outrage of modesty of one Johari Begum and on resistance, the father-in-law, Anwarul was inflicted blows by Lathi, danda and katta, subsequently, the said Anwarul died, hence Section 302 of the Indian Penal Code is added. On perusal of the case diary and materials on record and the period of custody, I am not inclined to grant the privilege

Patna High Court Cr.Misc. No.45337 of 2016 (3) dt.26-11-2016 2/2 of bail to the petitioners.

The bail application of the petitioners are hereby rejected.
