Mr. R.C.L. Das for the Agriculture Insurance Company (for short 'the Insurance Company') and Mr. P. K. Verma for the Managing Director, National Central Cooperative Bank of Battiah (respondent no.7) are present.

The application has been filed for payment of the insured

Patna High Court CWJC No.9643 of 2011 (5) dt.07-09-2015 2/2 amount pertaining to the Rabi and Kharip crops for the year 2008-09. Mr. Das states that the admissible amount has already been deposited/credited with the respondent-Cooperative Bank for payment to the eligible claimant(s).

Mr. Verma, on the other hand, states that the payments have been disbursed in favour of petitioner no.2(Md. Husnain Ansari). Insofar as petitioner no.1 (Hafiz Mian) is concerned, there was discrepancy in the name and address of the father of petitioner no.1. The Bank ascertained the correct address and the amount was disbursed to the petitioner no.1. On the strength of the aforesaid submissions, it has been submitted by both the counsel(s) that the writ application has become infructuous.

Non appearance of the counsel for the petitioners is indicative of the fact that they have lost interest in pursuing the case. Resultantly, the application is dismissed as having become infructuous.
