The petitioner seeks bail in Pakarideyal P.S. case No. 114 of 2016 under Section 272, 273 of the Indian Penal Code and under Section 47, 51, 52, 53,54 of Bihar Excise Act, 2016. The informant got information that one Balmiki Singh, resident of Madhuban, had kept concealed huge quantity of liquor in a cement store situated near the site of construction of over bridge.

It is submitted that the persons, who were apprehended, disclosed the name of petitioner. Nothing has been recovered from the conscious possession of the petitioner. Nobody has seen the petitioner keeping the liquor in the store. The

Patna High Court Cr.Misc. No.55564 of 2016 (3) dt.02-03-2017 2/2 petitioner is in jail since 25.09.2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, East Champaran at Motihari in Pakarideyal P.S. Case No. 114 of 2016.
