The petitioner, Lal Bahadur Yadav, apprehends his arrest in Kishanpur P.S. Case No.58 of 2012, registered under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.

The informant alleged that Anil Kumar and Lal Bahadur Yadav, the petitioner, being agent of Central Bank, Bahuarwa Branch, misappropriated his amount of K.C.C. in collusion with Binod Kumar Singh @ Binod Kumar, the Manager of the Bank.

Learned counsel for the petitioner submits that the petitioner is an agent and he has not withdrawn the amount from the account of the informant. The informant filed a petition in the Court below that he named the petitioner on the saying of others.

Patna High Court Cr.Misc. No.51935 of 2014 (2) dt.05-01-2015 2/2 Learned Additional Public Prosecutor, however, opposed the prayer for anticipatory bail.

Perused the record.

It appears that the informant made allegation that the petitioner withdrew the amount from his K.C.C. account, but it appears that Binod Kumar Singh @ Binod Kumar, the Manager of the Bank, has already been granted anticipatory bail by this Court vide order passed in Cr. Misc. No.29839 of 2013. Having considered the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No.58 of 2012, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
