JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-392 of the Indian Penal Code.
The present case was lodged against four unknown persons and the informant claimed that if, he gets opportunity to see the culprits, he will identify them.
In course of investigation, the name of petitioner appeared on the basis of suspicion and, subsequently, he was arrested and confessed his guilt, leading to recovery of stolen motorcycle from the house of other accused.
Submission on behalf of petitioner is that the petitioner is co-villager of the informant and had he participated in
Patna High Court Cr.Misc. No.42510 of 2016 (2) dt.06-10-2016 2/2 the alleged crime, he would certainly have been identified and named by the petitioner in his written report. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody since 14-07-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G.B. Nagar P.S. Case No. 156 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan. (Hemant Kumar Srivastava, J) A.K.V./- U T
