====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pachrukhi P.S. Case No. 172 of 2018 instituted for the offence under Sections 272, 273, 308 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that Police reached at NH-531 at Pachrukhi Bye-Pass and saw two persons. One person was carrying white plastic bag on his shoulder and another was keeping bag in his hand. The police chased them but they fled away after throwing the bag.

Counsel for the petitioner submits that petitioner is in custody since 26.7.2018.

From the written report it appears that there is no recovery from conscious possession of the petitioner.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Siwan, in connection with Pachrukhi P.S. Case No. 172 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
