The petitioners are apprehending their arrest in connection with Bhabua P.S. Case No. 273 of 2016 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that during investigation witnesses have not supported the prosecution case and the statement of the victim recorded under Section 164 Cr.P.C. has not supported the prosecution case also.

Having heard both sides and in view of the nature of allegation, let the petitioners, above named, surrender and pray for regular bail before the court below, who will consider the same on its own merit and also considering the statement of the victim girl under Section 164 Cr.P.C. as well the materials available on record and pass an appropriate order, if possible on the same day.
