JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A/34 of the Indian Penal Code. The basic accusation is of torture.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant on 18.06.2012. The informant has retracted from her initial version and filed a petition to that effect before the learned court below, the same has been brought on record as Annexure-2. It is further submitted that both sides have decided to part ways. In the circumstances, let the above named petitioner be released on provisional anticipatory bail for six months, in the event of arrest or surrender before the learned Court below within
Patna High Court Cr.Misc. No.43692 of 2015 (2) dt.15-09-2015 2/2 a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari in connection with Motihari Mahila P.S. Case No. 14 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioner will be confirmed by learned court below verification of the fact that the issue has been settled between the parties.
