JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This is an application for grant of anticipatory bail in connection with Lalganj P.S. Case No. 448 of 2018, disclosing offences under Sections 30(a), 32 (3), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that police during the patrolling recovered 205 pieces of bottles total 36 liters and 900 ml of foreign liquor from the hut of the petitioner. Submission of the learned counsel for the petitioner is that the hut does not belong to the petitioner and he has falsely been implicated in this case.

Having heard both sides, in view of the facts and

No.20983 of 2019(4) dt.25-06-2019 2/2 circumstances, as stated above, and there is prima facie allegation of recovery of liquor from the hut of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court on its own merit, without being prejudiced by order of this Court, if possible to be disposed of on the same day.
