The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 448, 354, 354D and 307 of the Indian Penal Code.
Accusation against the petitioner is that he created undue pressure on the informant for marriage and on refused by the informant the petitioner abused and given iron blow on her head, which caused injury.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present
Patna High Court Cr.Misc. No.45211 of 2016 (2) dt.16-12-2016 case. The petitioner is the brother-in-law of the informant. There are series of litigations going on between the parties at the instance of the mother of the informant. The nature of injury is said to be simple. Hence, no offence under Section 307 I.P.C. is made out.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with L.N.M.U. P.S. case No.170 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
