The petitioner seeks regular bail in connection with Parbatta (Maraiya) PS case no. 290 of 2018 registered for the offence punishable under Sections 25(1-b)a, 26, 35 of Arms Act. The allegation in the present case is that the police had apprehended the motorcycle on which the petitioner was a pillion rider and upon search, the police had recovered firearms and ammunitions from the person of the co-accused persons namely Manish Kumar whereafter the petitioner and the said co-accused persons were arrested.

The learned counsel for the petitioner submits that as far as the petitioner is concerned, there is no recovery of any firearm or ammunitions. It is further submitted that the

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Khagaria in connection with Parbatta (Maraiya) PS case no. 290 of 2018.
